Services Provided

Sealed by Sam- Notary Services offers mobile notary services, including but not limited to notarizing documents, administering oaths, and witnessing signatures. Our services are available in Rapid City, Box Elder, and Summerset, subject to availability and legal limitations. Certain documents or services may be excluded as required by law.

Purchases

When you make a purchase on the website, you will be using a third-party payment processor, Square, that will collect your payment information and process your payment. We are not responsible for the collection, use, sharing or security of your billing information by Square. The following payment method(s) are accepted by the third-party payment processor: Visa, Mastercard, American Express, Discover, Discover Diners, JCB and UnionPay International.

You hereby represent and warrant that you have the legal right to use the payment method(s) in connection with any purchase and that the information that you supply to us and to the third-party payment processor(s) is true, correct and complete.

User Responsibilities

Clients are expected to:

  • Bring a valid, government-issued photo ID to the appointment.

  • Ensure all parties involved in the notarization are present in person.

  • Ensure that documents are complete with no missing pages.

  • Ensure that the notary certificate is not signed beforehand.

  • Maintain respectful and professional behavior: Inappropriate behavior, such as offensive language, threats, or harassment, will not be tolerated and may result in termination of services and withholding of discounts, at our discretion.

Accounts

When you create an account on our website, you guarantee that you are 18 years of age or older and that the information that you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Website.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. General Dispute Resolution

In the event of any disputes arising from or relating to these terms and conditions or the services provided by Sealed by Sam, the parties agree to resolve such disputes through the following process:

The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Exceptions:

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s intellectual property rights.

This dispute resolution process is governed by the laws of the state of South Dakota.

Force Majeure

Sealed by Sam is not liable for any failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions of these terms will remain in full force and effect.

Governing Law

These terms are governed by the laws of the state of South Dakota.
